Sixth Circuit Finds Brady Duty in Hearsay Statements

The Sixth Circuit Court of Appeals recently held that unrecorded statements made to police (arguably inadmissible hearsay) should have been disclosed to the defense in a criminal prosecution as it “might have led directly to admissible evidence.” The hearsay could have led to the impeachment of the prosecution’s star witness as to his credibility, bias and motive to lie.
